Jury returns $28 million verdict in drunken crash after West Mifflin Elks Lodge event

Informative article about the dangers of a DUI offense and how one can be held liable for the injuries caused to another as a result of DUI. Additionally, the article touches on how establishments that serve alcohol to visibly intoxicated patrons can be held civilly liable for the injuries caused to another as a result of that patron driving under the influence after leaving a particular Bar.
Here, a jury in Allegheny County Pennsylvania awarded a verdict of $28 million dollars to the Plaintiffs as a result of a fatal crash in West Mifflin Pennsylvania involving a Defendant who left an establishment after being so intoxicated that his blood alcohol was more than twice the legal limit.
The Jury Verdict sends a strong and clear message to citizens of Pennsylvania: Do not drink and drive and do not aide others in drunk driving by serving alcohol to visibly intoxicated persons. If make the poor choice of driving under the influence, you will be arrested and ace stiff penalties. If you or your employees continue to serve alcohol to visibly intoxicated patrons, you could be held liable for their actions if they cause injuries to another after leaving your place of business.

Pa SB391 aims to expand Pennsylvania Expungement Law to include Misdemeanor Offenses

Introduced by State Senator Tim Solobay, Senate Bill 391 seeks to expand the current expungement laws of Pennsylvania. Currently, a person may seek to have summary charges expunged from their criminal record if they remain arrest free for five years following the guilty plea or guilty verdict for summary offenses. However, the current law only addresses minor "paper cut offenses" such as harassment, public urination, disorderly conduct, public intoxication, underage drinking, false id, reckless driving or other summary offenses.

Most of the aforementioned offenses will be adjudicated as a non-traffic summary offenses and may not show on some quick background checks. However, most, if not all, will probably show for more standard, stringent background checks ran by most federal and state agencies. But, as the law is currently written, only these summary offenses are eligible for the expugement process.

So, unless you are eligible for the ARD program following a DUI conviction or probation without verdict sentence following a conviction for simple possession of narcotics, one can only seek to wipe their record clean if they meet the criteria of the law as it currently stands: summary offense, 5 year waiting period.

What SB391 seeks to address are similar low level offenses that just so happen to be graded a little higher in the Pennsylvania Criminal System: Crimes charged as a misdemeanor of the second degree or misdemeanor of the third degree.  For example, disorderly conduct can be charged as a misdemeanor of the third degree or a summary offense. If SB391 is successfully signed into law, a person found guilty of disorderly conduct can eventually have the conviction expunged after a waiting period, whether the crime was graded as a summary offense or a misdemeanor of the third degree. Other low graded misdemeanors possibly eligible for expungement include, but is not limited to, theft, simple assault, defiant trespass or unsworn falsifications.

Click here to Read the Press Release regarding the new expungement law and click here to read the full text and status of the bill, including the inclusions of new eligible offenses with the noted exceptions for crimes excluded from eligibility. Currently, the bill has been passed by the Pa Senate and has been forwarded to the Pa House.

4th of July DUI Checkpoint Stop - Drug Dogs, Vehicle Search, Officer Questioning

DUI Checkpoints are commonplace around holidays, particularly summer holidays such as Memorial Day, Labor Day and Independence Day (4th of July). Officers know seem to use the stops to crack down on drunk driving, driving under the influence, underage drinking, traffic offenses, public intoxication, fake id and other criminal charges.

This past 4th of July weekend, a youtube video began circulating showing a young man going through a DUI Checkpoint. Once the video hit youtube, well, you know what happened: It went viral.

The video shows the young man entering the checkpoint, the encounters with the police officers and the subsequent "search" by the drug dogs.

The video raises several interesting constitutional and civility issues from the viewpoint of attorneys, police officers and citizens.

I encourage you to watch the video and discuss with your family and friends.

West Virginia to step up distracted-driving fight - Texting/CellPhone Ban goes in effect July 1, 2013

For years the evidence has shown that distracted drivers are just as dangerous, if not more dangerous, than drunk drivers.

With repeat news accounts of car accidents caused by a person distracted while texting or talking on the cell phone, the State West Virginia has taken a bold step to protect the citizens and visitors of their state by enacting a Distracted Driving Law that goes into effect July 1, 2013.

Facing a Probation Violation?

When arrested and convicted for a criminal offense, a Defendant can be sentenced to probation, which is typically a term of supervision by a probation officer where the Defendant is required to obey all laws, check in periodically with the assigned officer and most importantly, refrain from being arrested for any additional charges.

If the Defendant get arrested while on probation, the Judge who imposed the probation usually places a probation detain on the Defendant, which means, if the Defendant is arrested on new charges, goes to the county jail and posts bail, the Defendant will not be able to leave the jail due to the detainer being placed on their docket.

Probation detainers typically can only be addressed after the case for which the detainer was lodged is closed. For example, Defendant is on probation for Aggravated Assault and while on probation gets arrested for a DUI. A probation detainer is lodged due to the violation of probation: getting a new charge while on probation. In this case, the detainer will be addressed once the DUI charge is resolved and the Defendant remains in jail until the probation violation hearing.

An experienced criminal defense Attorney can assist with probation violations by suggesting alternative confinement placement for the Defendant to serve the detainer period. Or, in the Alternative, the Attorney can file a motion to have the detainer lifted by the original Judge who imposed the probation detainer.

In either case, the earlier the Attorney is involved in the case and made aware of the violation, the better chance of the detainer being lifted or transferred to another place of confinement.  Our experienced staff members are knowledgeable of probation detainers, violations and work hard to quickly to resolve the possible violation.

Things to Consider for a Bail Hearing

Our office receives many calls from clients seeking a bail attorney: Someone to argue for a bail reduction for a client.
Request for a bail reduction should be thoroughly researched prior to making the request. For example, how many times has the Defendant failed to appear in the past? Is the Defendant charged with a violent offense? What are the Defendant's ties to the community? Does the Defendant live in the jurisdiction?
These are just some of the questions the presiding Judge will need answered prior to even considering a bail reduction. An experienced Bail Attorney will review the Defendants entire background including family background, criminal history, meet with the bail agency and review all documents on the case prior to filing a petition requesting a reduction in bail.
If you are looking to hire an Attorney to file a petition for a bail reduction, contact our office today to schedule a free consultation and review of the paperwork for the case. Our staff will research the issue, file the petition and attend the hearing to request the reduction.

Mandatory Minimum State Sentences

In Pennsylvania, the sentencing commission has deemed that certain Defendants should be subject to mandatory minimum sentences in certain circumstances.
For example: A person who commits a violent offense with a deadly weapon is subject to a mandatory minimum sentence of 5 years. A person who is convicted of possession with the intent to deliver narcotics and it is proven by the preponderance of the evidence that he was in actual or constructive possession of a firearm, he is subject to a mandatory minimum sentence of 5 years in state prison. The sentencing judge has no discretion in imposing these sentences.
If you have been charged with possession of a firearm while also charged with possession with intent to deliver narcotics, contact our law firm immediately to discuss your options. In some instances, the mandatory sentence can be negotiated. In other cases, the best possible case will be to opt to for a trial.

The decision to plead guilty or opt for a trial is the decision of the client. However, such decision should not be made without consultation with an experienced attorney and knowledge of all the possible penalties.

Contact our lawfirm today to schedule a free consultation.

What to Do when Facing Multiple DUI Charges?

Have you or someone you love been charged with DUI? For first time offenders, you may be eligible for the ARD program where, upon successful completion, you are eligible for an expungement. However, when charged with a second or subsequent DUI charge, the rules change.

In Pennsylvania, you are only eligible for the ARD program every 10 (Ten) years. Therefore, more than one DUI arrests within ten years require special attention as you can be subject to maximum penalties that include, but are not limited to: probation, house arrest or even jail time.  Multiple DUI's must be evaluated on a case by case basis.

For example, a person who has been arrested for a second DUI within ten years and the DUI involves an accident is different than a person who has a third DUI within ten years with no accident but refused the breathalyzer at the scene.

You need an experienced DUI lawyer to review your case, go over all the possible options and show you the likely outcome. In some instances, an experienced attorney may be able to help you avoid jail time by suggesting alternative confinement options.  Contact our Office Today to schedule a Free consultation: 412.315.7441

Missed a Formal Arraignment?

A Formal Arraignment is where you are formally presented with your charges in Pennsylvania. The Formal Arriagnement date is given at or immediately after the conclusion of your preliminary hearing.

At the Formal Arraignement, you will receive a document called a Criminal Information which lists all of your charges and the elements of the same. Moreover, this is stage is where you are first given the opportunity to file for the discovery in your case.

It is very important that you attend your formal arraignment becuase you will be given a subpoena for your pre-trial conference where you will select your trial date. If you do not attend the formal arraignement, a warrant may be issued for your arrest. Once a warrant is issued, authorities are authorized to arrest you on site: whether at your home, place of employment or out with family.

Once you receive a subpoena for your formal arraignement, contact your attorney immediately to verify the time, date and location of the arraignment and to discuss any questions you may have concerning your case. If you have missed your arraignement, contact an attorney immediately to address the pending bench warrant.

Do I need an Expungement?

When you are charged with a crime, there is a record of the crime in the criminal justice system. If you are found "not guilty" of the charges or the charges are withdrawn or dismissed, you may be entitled to have the charges erased or expunged from your record.
Being found "not guilty" of charges is not enough to protect your reputation. Potential employers, loan officers and school administrators can still see that you were charged with the offense and, although you were acquitted of the charges, they may still hold against you that you were charged with the offense, regardless of the outcome.
By having your record expunged, the arrest, charges and outcome can all be erased from the system as if they never existed.
If you are looking to have your record expunged, contact an experiencedattorney today to discuss your options.

Am I required to speak with Police?

Many times at our law firm, we receive calls asking if a suspect is required to go to the police station and voluntarily submit to a police interview. The answer is always a resounding, "NO!"

Here is a a simple test to determine if you are required to answer any questions or submit to any interview: Are the police asking you to answer questions?

Here are examples of police asking permission:

"Do you mind answering a few questions?"

"Can you come down to the police station and speak with us?"

"We just want to clear up a few things, do you want to help us?"

If the police are asking for your permission, that is a clear sign that they lack authority to require you to do what they are asking. Play it safe, call a lawyer.

Do you Really need a Criminal Lawyer?

Our firm receives numerous calls from potential clients every day seeking advice on how to handle a legal situation. On many occasions, the potential clients retain our services and become actual clients. Some of the callers seek counsel elsewhere because they do not like our assessment of their legal situation. Unfortunately, there is a small percentage of callers who contact our firm with the specific purpose of obtaining information from a lawyer in an effort to handle their own legal matter without a lawyer.

These callers are simply unwilling to listen to any advice or follow the direction of any lawyer and simply think they can handle their legal matter alone. This is not advisable. Legal matters are inherently complex. Whether you are facing a preliminary hearing, an interview with police or are the target of a federal grand jury investigation, you need an experienced Criminal Defense Lawyer to explain all of the potential penalties, outcomes and fines that may accompany these situations.

Do yourself a favor: When faced with a potential criminal matter, contact a Criminal Lawyer with the experience to advise you of your options and listen to the advice given.

Do you Really Need a Lawyer for a Pittsburgh Traffic Offense?

Let's face it: Traffic Tickets are a pain. The offenses seem to pop up at the most inopportune time forcing you spend time out of your trip with the police officer, stressing over the fines and costs of the ticket before taking a day off from work to deal with the traffic ticket in Court. It is no wonder why most people charged with a traffic offense simply opt to plead guilty and send in the citation to move on with their lives: This is a huge mistake.

Although traffic offenses are seemingly harmless when compared to a Casino Crime, Federal Crime or DUI, the long lasting impact of pleading guilty will hit you when you least expect it. By simply pleading guilty to driving without a license or careless driving can possibly lead to jail time and/or maximum fines. Entering a plea of guilty to driving without a license due to a DUI suspension can lead to a 90 day jail sentence and additional license suspensions from Pennsylvania Department of Transportation.

The next time you or a loved on receive a traffic ticket, contact our law firm for a free consultation. We will review the paperwork, citations and advise you of your options free of charge.

Charged with Conspiracy in Pennsylvania

Conspiracy is a vague but far reaching crime. Many view a conspiracy crime as actively planning a bank robbery or driving a get away car after a robbery. In most cases, these examples are accurate. However, what most citizens do not realize is that conspiracy can be charged in instances where the person is not even present at the scene of the crime but agreed to commit the crime at an earlier point and made acts towards the completion of the crime even if not present at the scene of the actual crime. For example: Arranging drug transactions by phone, paying another person to commit an assault or assisting a person in committing a burglary by luring the home owners away to another location under false pretenses.

The important distinction that must be made in every conspiracy case is the identification of an agreement, whether actual or implied by actions. Often, police officers and detectives will threaten to charge everyone present at the scene of a crime with conspiracy in an attempt to scare someone into testifying against another. However, Pennsylvania law is clear: Presence at the scene of a crime, standing alone, is not evidence of conspiracy.

Thus, if you or anyone you know has been charged with or is threatening to be charged with conspiracy, stand firm on your rights: Remain silent and contact Attorney Frank Walker for a free case review.

Making a Case for Slip and Fall in Pennsylvania

In Pennsylvania, a store or business owner owes a duty of care to customers whom frequent their stores for business purposes. Such visitors are called invitees and the owner is required to inspect and maintain his premises free from dangerous conditions.

when clients are injured on the property of a business owner or corporation, the first response in defense to liability from the business owner is, "We were not aware of the condition, therefore we can not be held liable." The injured party thinks this is the end and never pursues the case. The injured party is instead left with a pile of medical bills and forced to endure a season of lost wages from missing work simply because they don't think they have a case.

This is why consulting with an attorney familiar with claims for premises liability is so important. An experienced attorney will fight back and request documents to prove that business owner, knew or should have known about the dangerous condition because it was their responsibility to inspect and keep the premises safe.

If you or someone you love has been injured on the property of a business owner, contact our law firm today for a free consultation and review of the case.

Charged with Homicide in Pittsburgh?

Every Criminal Charge in the Pennsylvania Code should be taken seriously. Whether a DUI, underage drinking or narcotics charge, a conviction can half life changing impact on your liberty. However, none of these charges can actually put your life in jeopardy like a charge of Homicide.

In Pennsylvania, a general count of Homicide encompasses five (5) charges: Murder 1, Murder 2, Murder 3, Voluntary Manslaughter, Involuntary Manslaughter. The maximum penalties range from 5 years in prison to a sentence of Death.

When citizens of the Commonwealth are choosing an attorney to defend a homicide case, special attention should be given to the experience of the attorney. Homicide cases are tedious, all consuming and require a specific attention to detail.

At Frank Walker Law, our attorneys are experienced homicide attorneys with results to support such claim. As a charter member of the Allegheny County Office of Conflict Counsel, Attorney Frank Walker has successfully tried numerous homicide cases, jury and non jury, to verdict. Additionally, attorney Walker has been appointed to represent homicide clients on appeal to both the Superior and Supreme Court of Pennsylvania.

It is no accident that many clients choose Frank Walker Law to represent their loved ones in all criminal matters, especially charges of Criminal Homicide.

First Weekend of Pittsburgh South Side Saturation Patrols = 19 arrests, 94 citations

After the Southside Saturation Police Detail was announced by the mayor, the results were instant: multiple criminal arrests and numerous patrons and visitors cited for traffic and non-traffic offenses on Pittsburgh South Side.

Equipped with both uniformed and undercover officers, the local police arrested and cited patrons for multiple offenses: traffic offenses, dui, underage drinking, fake id, public urination, disorderly conduct, public intoxication, simple assault and various other offenses.

With only one weekend into the new security measure and multiple arrests to report, it's safe to say that patrons should be on their best behavior when visiting the many establishments on the South Side. Additionally, plan ahead by locking in the number for a Taxi (Yellow Cab 412.321.8100) before hitting the town.

Pittsburgh South Side to See Increased Police Presence

Pittsburgh Mayor Luke Ravenstahl recently announced a new security plan for the bars, stores, shops and other businesses on the South Side of Pittsburgh along East Carson Street: More Police Presence.

With recent crimes occurring on the South Side, including hit and run accidents, DUI accidents, Assaults, Firearms violations, underage drinking, disorderly conduct, public intoxication and public urination, the Police Blitz is a welcomed idea for business owners on the South Side.

The mayor also announced that other safety measures will be increased such as building inspectors, firefighters and towing enforcement in an effort to curb the crimes and violence on the South Side frequently occurring during the evening hours.

This announcement should not be taken lightly, especially by frequent patrons, visitors and students whom visit the South Side Shops and businesses. The Message is simple: Come to the South Side, have a drink, enjoy your friends, have a great time, but please do so responsibly or suffer the consequences.

If you or someone you know has been charged or cited with a crime while visiting the South Side, please give our office a call for a free review of your case.

Pittsburgh Medical Malpractice Attorney

People often associate the phrase "Medical Malpractice" to egregious physical acts of doctors such as amputating the wrong leg, or leaving a scalpel inside the sternum of a patient during surgery. However, medical malpractice can range from the physical acts to the non physical actions.

For example: A medical professional can be held liable for professional negligence/medical malpractice in Pennsylvania for deviating from an appropriate standard of care, i.e. failing to diagnose a disease, giving poor advice directing a patient not to take appropriate action when the medical standards require otherwise.

If you or a loved one think you may be a victim of medical malpractice, contact our law firm immediately for a free consultation.

Do You Really Need a Pittsburgh Personal Injury Attorney?

This is a common question. After every accident, the insurance companies will immediately start contacting the parties, witnesses, police officers and hospitals to obtain all records, reports and valuable information to work towards a quick resolution.

Part of that immediate action will undoubtedly involve a call to the parties with a financial offer in exchange for their agreement not to file a lawsuit. Most people think, "Take the money and Run!" This is not always the best decision. An immediate settlement almost always leaves out the possibility of future injuries or aggravation of present injuries, future economic loss, lost wages and any other costs associated with the accident.

That is why it is so important to first speak with a Personal Injury Lawyer to assess your rights and possible damages from the accident prior to speaking with any representative from an insurance company.
