Jury returns $28 million verdict in drunken crash after West Mifflin Elks Lodge event

Pa SB391 aims to expand Pennsylvania Expungement Law to include Misdemeanor Offenses

Introduced by State Senator Tim Solobay, Senate Bill 391 seeks to expand the current expungement laws of Pennsylvania. Currently, a person may seek to have summary charges expunged from their criminal record if they remain arrest free for five years following the guilty plea or guilty verdict for summary offenses. However, the current law only addresses minor "paper cut offenses" such as harassment, public urination, disorderly conduct, public intoxication, underage drinking, false id, reckless driving or other summary offenses.
 
Most of the aforementioned offenses will be adjudicated as a non-traffic summary offenses and may not show on some quick background checks. However, most, if not all, will probably show for more standard, stringent background checks ran by most federal and state agencies. But, as the law is currently written, only these summary offenses are eligible for the expugement process.
 
So, unless you are eligible for the ARD program following a DUI conviction or probation without verdict sentence following a conviction for simple possession of narcotics, one can only seek to wipe their record clean if they meet the criteria of the law as it currently stands: summary offense, 5 year waiting period.
 
What SB391 seeks to address are similar low level offenses that just so happen to be graded a little higher in the Pennsylvania Criminal System: Crimes charged as a misdemeanor of the second degree or misdemeanor of the third degree.  For example, disorderly conduct can be charged as a misdemeanor of the third degree or a summary offense. If SB391 is successfully signed into law, a person found guilty of disorderly conduct can eventually have the conviction expunged after a waiting period, whether the crime was graded as a summary offense or a misdemeanor of the third degree. Other low graded misdemeanors possibly eligible for expungement include, but is not limited to, theft, simple assault, defiant trespass or unsworn falsifications.

Pittsburgh ChildLine Expunction Attorney

4th of July DUI Checkpoint Stop - Drug Dogs, Vehicle Search, Officer Questioning

DUI Checkpoints are commonplace around holidays, particularly summer holidays such as Memorial Day, Labor Day and Independence Day (4th of July). Officers know seem to use the stops to crack down on drunk driving, driving under the influence, underage drinking, traffic offenses, public intoxication, fake id and other criminal charges.
 
This past 4th of July weekend, a youtube video began circulating showing a young man going through a DUI Checkpoint. Once the video hit youtube, well, you know what happened: It went viral.



The video shows the young man entering the checkpoint, the encounters with the police officers and the subsequent "search" by the drug dogs.
 
The video raises several interesting constitutional and civility issues from the viewpoint of attorneys, police officers and citizens.

West Virginia to step up distracted-driving fight - Texting/CellPhone Ban goes in effect July 1, 2013

For years the evidence has shown that distracted drivers are just as dangerous, if not more dangerous, than drunk drivers.

Facing a Probation Violation?

When arrested and convicted for a criminal offense, a Defendant can be sentenced to probation, which is typically a term of supervision by a probation officer where the Defendant is required to obey all laws, check in periodically with the assigned officer and most importantly, refrain from being arrested for any additional charges.
 
If the Defendant get arrested while on probation, the Judge who imposed the probation usually places a probation detain on the Defendant, which means, if the Defendant is arrested on new charges, goes to the county jail and posts bail, the Defendant will not be able to leave the jail due to the detainer being placed on their docket.
 
Probation detainers typically can only be addressed after the case for which the detainer was lodged is closed. For example, Defendant is on probation for Aggravated Assault and while on probation gets arrested for a DUI. A probation detainer is lodged due to the violation of probation: getting a new charge while on probation. In this case, the detainer will be addressed once the DUI charge is resolved and the Defendant remains in jail until the probation violation hearing.
 
An experienced criminal defense Attorney can assist with probation violations by suggesting alternative confinement placement for the Defendant to serve the detainer period. Or, in the Alternative, the Attorney can file a motion to have the detainer lifted by the original Judge who imposed the probation detainer.

Things to Consider for a Bail Hearing

Mandatory Minimum State Sentences

In Pennsylvania, the sentencing commission has deemed that certain Defendants should be subject to mandatory minimum sentences in certain circumstances.
For example: A person who commits a violent offense with a deadly weapon is subject to a mandatory minimum sentence of 5 years. A person who is convicted of possession with the intent to deliver narcotics and it is proven by the preponderance of the evidence that he was in actual or constructive possession of a firearm, he is subject to a mandatory minimum sentence of 5 years in state prison. The sentencing judge has no discretion in imposing these sentences.

What to Do when Facing Multiple DUI Charges?

Missed a Formal Arraignment?

A Formal Arraignment is where you are formally presented with your charges in Pennsylvania. The Formal Arriagnement date is given at or immediately after the conclusion of your preliminary hearing.
 
At the Formal Arraignement, you will receive a document called a Criminal Information which lists all of your charges and the elements of the same. Moreover, this is stage is where you are first given the opportunity to file for the discovery in your case.
 
It is very important that you attend your formal arraignment becuase you will be given a subpoena for your pre-trial conference where you will select your trial date. If you do not attend the formal arraignement, a warrant may be issued for your arrest. Once a warrant is issued, authorities are authorized to arrest you on site: whether at your home, place of employment or out with family.
 
Once you receive a subpoena for your formal arraignement, contact your attorney immediately to verify the time, date and location of the arraignment and to discuss any questions you may have concerning your case. Do I need an Expungement?

When you are charged with a crime, there is a record of the crime in the criminal justice system. If you are found "not guilty" of the charges or the charges are withdrawn or dismissed, you may be entitled to have the charges erased or expunged from your record.
Being found "not guilty" of charges is not enough to protect your reputation. Potential employers, loan officers and school administrators can still see that you were charged with the offense and, although you were acquitted of the charges, they may still hold against you that you were charged with the offense, regardless of the outcome.
By having your record expunged, the arrest, charges and outcome can all be erased from the system as if they never existed.

Plead Guilty to Summary Offense?

When most peole receive a citation for a summary offense, the first reaction is usually, "It's just a summary, it really can't hurt me that bad, right?" WRONG.
 
Summary offenses carry jail time and a $300 fine. Also, some summary offenses, such as underage drinking or fake id, can carry a license suspension and an increase in your insurance premiums.

Am I required to speak with Police?

Many times at our law firm, we receive calls asking if a suspect is required to go to the police station and voluntarily submit to a police interview. The answer is always a resounding, "NO!"
 
Here is a a simple test to determine if you are required to answer any questions or submit to any interview: Are the police asking you to answer questions?
 
Here are examples of police asking permission:
 
"Do you mind answering a few questions?"
 
"Can you come down to the police station and speak with us?"
 
"We just want to clear up a few things, do you want to help us?"

If the police are asking for your permission, that is a clear sign that they lack authority to require you to do what they are asking. Play it safe, call a lawyer.

Charged with Conspiracy in Pennsylvania

Conspiracy is a vague but far reaching crime. Many view a conspiracy crime as actively planning a bank robbery or driving a get away car after a robbery. In most cases, these examples are accurate. However, what most citizens do not realize is that conspiracy can be charged in instances where the person is not even present at the scene of the crime but agreed to commit the crime at an earlier point and made acts towards the completion of the crime even if not present at the scene of the actual crime. For example: Arranging drug transactions by phone, paying another person to commit an assault or assisting a person in committing a burglary by luring the home owners away to another location under false pretenses.
 
The important distinction that must be made in every conspiracy case is the identification of an agreement, whether actual or implied by actions. Often, police officers and detectives will threaten to charge everyone present at the scene of a crime with conspiracy in an attempt to scare someone into testifying against another. However, Pennsylvania law is clear: Presence at the scene of a crime, standing alone, is not evidence of conspiracy.

First Weekend of Pittsburgh South Side Saturation Patrols = 19 arrests, 94 citations

After the Southside Saturation Police Detail was announced by the mayor, the results were instant: multiple criminal arrests and numerous patrons and visitors cited for traffic and non-traffic offenses on Pittsburgh South Side.
 
Equipped with both uniformed and undercover officers, the local police arrested and cited patrons for multiple offenses: traffic offenses, dui, underage drinking, fake id, public urination, disorderly conduct, public intoxication, simple assault and various other offenses.
 
With only one weekend into the new security measure and multiple arrests to report, it's safe to say that patrons should be on their best behavior when visiting the many establishments on the South Side. Pittsburgh South Side to See Increased Police Presence

Pittsburgh Mayor Luke Ravenstahl recently announced a new security plan for the bars, stores, shops and other businesses on the South Side of Pittsburgh along East Carson Street: More Police Presence.
 
With recent crimes occurring on the South Side, including hit and run accidents, DUI accidents, Assaults, Firearms violations, underage drinking, disorderly conduct, public intoxication and public urination, the Police Blitz is a welcomed idea for business owners on the South Side.
 
The mayor also announced that other safety measures will be increased such as building inspectors, firefighters and towing enforcement in an effort to curb the crimes and violence on the South Side frequently occurring during the evening hours.
 
This announcement should not be taken lightly, especially by frequent patrons, visitors and students whom visit the South Side Shops and businesses. The Message is simple: Come to the South Side, have a drink, enjoy your friends, have a great time, but please do so responsibly or suffer the consequences.
